If Your Home is Improperly Designed or Constructed...
If your home has been improperly designed or constructed, you have rights that must be protected. A builder of residential property is required to construct the property in a "good and workmanlike" manner. Failure to do so usually gives homeowners the right to take legal action. A homeowner has ten (10) years, not merely the one (1) year warranty period, to request that construction defects be repaired.
You should know that the expiration of the one-year warranty on construction does not prevent you from taking action against the builder. In fact, you have up to ten years to file a lawsuit against your builder for construction defects. However, you should talk with a construction law attorney as soon as you know something is wrong.
