Products Liability
Defectively designed and manufactured products injure, kill and maim hundreds of thousands of people each year. Our lawyers can assist people who have suffered severe injuries caused by dangerous or defective products. There are many ways in which a product can be defective, including improper warnings, design defects or manufacturing defects. We handle different types of products liability lawsuits across a broad spectrum of products, from small hand held items such as saws to vehicle parts, farm equipment and machinery. In addition, products liability claims can involve medical equipment, drugs and medications.
Premises Liability
When a person is injured on someone else's property, it may be possible to bring a successful premises liability lawsuit. One notable type of premises liability case is a "slip and fall" accident. This may occur if an owner of a property such as a store, restaurant, or hotel fails to ensure the floors are clean and free of slipping or tripping hazards. The trial lawyers at Miller Law, Inc. can also represent plaintiffs in premises liability lawsuits involving injuries caused by attacks on private property due to inadequate security, lighting or other conditions.
Toxic Mold
Toxic mold can cause severe, debilitating and often permanent personal injuries, as well as property damage. At Miller Law, Inc., our trial lawyers have achieved a record of success in representing thousands of individuals who were injured or damaged by toxic mold. Toxic mold claims can arise in connection with Miller Law, Inc.'s real estate, construction defect and landlord/tenant practice. One notable outcome is a November 2001 jury verdict of $2.7 million. This verdict was the largest in United States history in a case involving personal injuries caused by toxic mold.
Personal Injury
Headquartered in central California, Miller Law, Inc. handles serious personal injury matters for injured men, women and children across the state. We represent people who have experienced life-changing injuries, including burns, scars and disfigurement, brain injuries, neck and back injuries, fractures, amputations and poisoning. Many of our clients have missed work and accrued extensive medical bills. They depend on our efforts to help make things right again, and to obtain monetary compensation for their injuries, including medical expenses, pain and suffering and lost wages.
We also represent the surviving families of people killed in accidents of all kinds by filing wrongful death lawsuits in courts statewide.
Construction Defects
Litigation may be necessary when a builders' acts or omissions have resulted in construction defect that cause injury, property damage or loss to purchasers of homes or condominiums. At Miller Law, Inc., we represent plaintiffs whose homes have been damaged by construction defects, including leaking roofs, windows, stucco or plumbing. Such defects can lead to the development of toxic mold. These molds can damage the structure of the home, the contents therein, and also cause severe personal injuries.
Landlord/Tenant
Our team of experienced trial lawyers also represents tenants in landlord/tenant litigation arising out of the failure to maintain or repair rental properties, including apartments, condominiums, single family homes and commercial buildings and offices. Our clients include people involved in disputes over water intrusion, water leaks, gas leaks, toxic mold, asbestos and lead exposure.
Real Estate
Miller Law, Inc. represents buyers of real property (i.e., houses, condominiums, townhomes, office buildings) in lawsuits against sellers, realtors, home inspectors and pest inspectors arising out of the inadequate inspection and/or failure to disclose defects in these properties. Such lawsuits include claims for the costs of repairing the undisclosed defect (such as toxic mold contamination) and/or rescission of the sales contract. Rescission involves the "unwinding" of the sales contract to return the client to the position as if the purchase had never been made. IN 2010 Miller Law, Inc. obtained an arbitration award with a value in excess of $5 million which mandated the recission of 24 condominiums purchased by Miller Law, Inc. clients.
Insurance Bad Faith
Insurers often act in bad faith, wrongly denying claims, delaying in making payments for claims or undervaluing claims and losses. This often occurs relative to homeowners, disability or health insurance policies. As attorneys with decades of experience, we are well qualified to represent individuals and businesses in these insurance disputes.
